About the Report

Hogan Lovells commissioned Legal Week to conduct a survey into attitudes amongst major organisations into litigation trends and the current challenges facing in house counsel.  Over 203 General Counsel and Heads of Legal Services were asked nearly 40 questions across a number of issues, in September 2011. 84% were based in the UK and 30% of respondents worked in an organisation with a turnover of more than £1 billion.

The survey was a multiple choice questionnaire carried out by the Legal Week Intelligence Unit.  The questions presented to the respondents asked them to choose among prompted responses and to rank in order of importance pre-specified factors that might affect the demand for litigation and the importance of England as a centre for dispute resolution in comparison to geographic regions outside of the UK.  

A broad range of issues were probed including:
  • what effects the downturn has caused
  • areas in-house counsel have seen an increase in litigation such as general commercial disputes, employment related cases, regulatory actions and fraud and bribery matters. 
  • feedback on the challenges of international disputes
  • extent of innovation in case management and cost efficiencies
