Key Findings

Hogan Lovells in conjunction with Legal Week surveyed more than 200-in house counsel to garner their thoughts and impressions on a range of litigation-related topics.  
  • 53% say there has been an increase in legal advice to their company’s board 
  • Upsurge in disputes are in the following areas: 39% commercial/contractual, 34% regulatory, 29% employment and 26% fraud/bribery 
  • 46% have seen an increase in international disputes 
  • When asked to identify jurisdictions in which their litigation experience had been worse than in the UK, Italy topped the list (36%) followed by France (30%), India (28%), Middle East (27%) and China (27%)
  • 43% spend more than 20% of their annual legal spend on dispute resolution 
  • Almost one fifth of organisations spend more than 70% of their total legal spend on dispute resolution. 53% spend more than 20%
  • 28% say that legal spend has increased over the past 12 months 
  • The biggest impact of the recession has been faster settlement of cases (cited by 26% of respondents) and handling more disputes in-house (25%) 
  • 51% of respondents instruct the Bar directly, and 26% do so more than a few times a year.
